Soak & Save Club Terms & Conditions
1. About the Programme
The Soak & Save Club ("the Programme") is a free loyalty rewards programme operated by Portable Spas New Zealand ("we", "us", "our"). By participating in the Programme, you agree to these Terms and Conditions ("Terms"). Please read them carefully before joining.
2. Eligibility and Membership
- The Programme is open to individuals aged 18 years or older who reside in New Zealand.
- Membership is limited to one account per person. Accounts may not be shared between individuals, families, or organisations.
- To join, you must create an online account at portablespas.co.nz. Membership is linked to your shop account.
- Existing customers with an online account as at the Programme launch date are automatically enrolled. You may opt out of the Programme at any time by contacting us.
- Opting out of marketing emails does not cancel your Programme membership. Email and Programme participation are managed separately.
- You are responsible for maintaining accurate, up-to-date account information and for keeping your login details secure.
3. Earning Points
- Members earn points on qualifying purchases made through portablespas.co.nz while logged into their account.
- Points are awarded at the rate advertised on the Programme page at the time of purchase (currently 5% back in points).
- Points are calculated on the product price and do not include shipping costs, taxes, or any discount applied.
- Points will be credited to your account once the associated order has been fulfilled and any applicable return or refund period has passed.
- Points earned through fraudulent, manipulated, or unauthorised transactions may be revoked at our discretion.
4. Redeeming Points
- Points may be redeemed for discounts on future purchases through portablespas.co.nz.
- There is no minimum order value required to redeem points.
- Points have no cash value and cannot be exchanged for cash, transferred to another person, or sold.
- Points may not be applied retrospectively to previous orders.
- Redeemed points cannot be reinstated if an order is returned or refunded; however, any points originally earned on the returned order may also be deducted from your balance.
5. Member Discounts and Benefits
Current member benefits include:
- Free shipping on filter cartridge orders, with an additional $20 discount on filter twin packs.
- 10% discount on all chemical purchases and annual service bookings.
- Free shipping on all orders over $1,050 NZD.
- Points earned on purchases as described in Section 3.
To access these benefits, you must be logged into your account at checkout and choose to apply them. Benefits cannot be claimed retroactively on past orders.
6. Referral Programme
- Members may refer friends and family to Portable Spas New Zealand through the referral link provided in their account.
- When a referred person makes their first qualifying spa pool purchase, the new customer receives a $150 NZD discount and the referring member receives a $50 NZD store credit.
- The referral discount applies to spa pool purchases only and cannot be used on accessories, chemicals, replacement parts, or services.
- Referral rewards are subject to the new customer completing a qualifying spa pool purchase that is not subsequently returned or refunded.
- Self-referrals or referrals between accounts controlled by the same person are not permitted.
- Portable Spas New Zealand reserves the right to withhold or revoke referral rewards where abuse or manipulation is suspected.
7. Discount and Coupon Stacking
- Unless specifically stated otherwise, member discounts and loyalty point redemptions may not be combined with other promotional codes, vouchers, or discount offers.
- We will make it clear on the Programme page and at checkout which discounts can be used together.
8. Changes to the Programme
- Portable Spas New Zealand reserves the right to modify, suspend, or discontinue the Programme, or any aspect of it, at any time without prior notice.
- This includes the right to change the rate at which points are earned or redeemed, adjust member benefits and discounts, add or remove Programme features, or update these Terms.
- Where practicable, we will notify members of material changes via email or on our website. However, changes take effect from the date they are published, regardless of whether individual notice has been given.
- Members do not acquire any vested right or entitlement to the continued availability of any particular benefit, discount, or points redemption level.
9. Termination
- You may cancel your Programme membership at any time by contacting us or closing your online account. Upon cancellation, any unredeemed points will be forfeited.
- We may terminate or suspend your membership at our discretion if we reasonably believe you have breached these Terms, engaged in fraudulent or abusive conduct, or misused the Programme in any way.
- If the Programme is discontinued entirely, we will endeavour to provide reasonable notice. Upon Programme termination, all unredeemed points will be forfeited without any obligation or liability on our part.
10. Limitation of Liability
- The Programme is provided on an "as is" basis. While we make every effort to ensure the Programme operates smoothly, we accept no liability for technical issues, system errors, lost points, or delays in processing rewards that are beyond our reasonable control.
- To the maximum extent permitted by New Zealand law, Portable Spas New Zealand's total liability arising from or related to the Programme is limited to the value of the points or benefits in dispute.
- Nothing in these Terms excludes or limits any rights you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other New Zealand legislation that cannot be excluded by agreement.
11. Privacy
- Personal information collected through the Programme is handled in accordance with our Privacy Policy, available at portablespas.co.nz.
- We collect and use your information to administer the Programme, process rewards, communicate Programme updates, and improve our service.
- Your information will not be sold to third parties. For full details on how we handle your data, please refer to our Privacy Policy.
12. General
- These Terms are governed by the laws of New Zealand. Any dispute arising from or relating to the Programme will be subject to the non-exclusive jurisdiction of the New Zealand courts.
- If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
- Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
- These Terms constitute the entire agreement between you and Portable Spas New Zealand regarding the Programme and supersede any prior communications or agreements on this subject.
